What if the Constitution No Longer Applied?

http://www.informationclearinghouse.info/article29852.htm

By Judge Andrew Napolitano
November 30, 2011 "Information Clearing House" --

What if the whole purpose of the Constitution was to limit the government?
What if Congress' enumerated powers in the Constitution no longer limited Congress, but were actually used as justification to extend Congress' authority over every realm of human life?
What if the president, meant to be an equal to Congress, has become a democratically elected, term-limited monarch?
What if the president assumed everything he did was legal, just because he's the president?
What if he could interrupt your regularly scheduled radio and TV programming for a special message from him?
What if he could declare war on his own?
What if he could read your emails and texts without a search warrant?
What if he could kill you without warning?

What if the rights and principles guaranteed in the Constitution have been so distorted in the past 200 years as to be unrecognizable by the Founders?

What if the states were mere provinces of a totally nationalized and fully centralized government?
What if the Constitution was amended stealthily, not by constitutional amendments duly passed by the states, but by the constant and persistent expansion of the federal government's role in our lives?
What if the federal government decided whether its own powers were proper and constitutional?

What if you needed a license from the government to speak, to assemble or to protest the government?

What if the right to keep and bear arms only applied to the government?
What if posse comitatus -- the law that prohibits our military from our streets -- were no longer in effect?
What if the government considered the military an adequate dispenser of domestic law enforcement?
What if cops looked and acted like troops and you couldn't distinguish the military from the police?
What if federal agents could write their own search warrants in defiance of the Constitution?
What if the government could decide when you weren't entitled to a jury trial?

What if the government could take your property whenever it wanted it?

What if the government could continue prosecuting you until it got the verdict it wanted?
What if the government could force you to testify against yourself simply by labeling you a domestic terrorist?
What if the government could torture you until you said what the government wanted to hear?
What if people running for president actually supported torture?
What if the government tortured your children to get to you?
What if the government could send you to your death and your innocence meant nothing so long as the government's procedures were followed?
What if America's prison population, the largest in the world, was the result of a cruel and unusual way for a country to be free?
What if half the prison population never harmed anyone but themselves?

What if the people had no rights except those the government chose to let them have?

What if the states had no rights except to do as the federal government commanded?
What if our elected officials didn't really live among us, but all instead had their hearts and their homes in Washington, D.C.?
What if the government could strip you of your rights because of where your mother was when you were born?
What if the income tax was unconstitutional?
if the states were convinced to give up their representation in Congress?
What if the government tried to ban you from using a substance older than the government itself?
What if voting didn't mean anything anymore because both political parties stand for Big Government?

What if the government could write any law, regulate any behavior and tax any event, the Constitution be damned?

What if the government was the reason we don't have a Constitution anymore?
What if you could love your country but hate what the government has done to it?
What if sometimes to love your country, you had to alter or abolish the government?
What if Jefferson was right?
What if that government is best which governs least?
What if I'm right?
What if the government is wrong?
What if it is dangerous to be right when the government is wrong?
What if it is better to perish fighting for freedom than to live as a slave?
What if freedom's greatest hour of danger is now?

Welcome to the wonderful world of the Republican Party. Or rather: to the distorted world of its presidential campaign. The Senate is going to vote on whether Congress will give this president—and every future president — the power to order the military to pick up and imprison without charge or trial civilians anywhere in the world.

S. 1867, the National Defense Authorization Act bill, which will be on the Senate floor on Monday. The bill was drafted in secret by Sens. Carl Levin (D-Mich.) and John McCain (R-Ariz.) and passed in a closed-door committee meeting, without even a single hearing.

Paul Craig Roberts: Bankers Have Seized Europe

Goldman Sachs Has Taken Over
http://www.informationclearinghouse.info/article29823.htm

If any of the European sovereign debt fails, US financial institutions that issued swaps or unfunded guarantees against the debt are on the hook for large sums that they do not have. The reputation of the US financial system probably could not survive its default on the swaps it has issued. Therefore, the failure of European sovereign debt would renew the financial crisis in the US, requiring a new round of bailouts and/or a new round of Federal Reserve “quantitative easing,” that is, the printing of money in order to make good on irresponsible financial instruments, the issue of which enriched a tiny number of executives.

The European Union, just like everything else, is merely another scheme to concentrate wealth in a few hands at the expense of European citizens, who are destined, like Americans, to be the serfs of the 21st century.

"The evolution of culture is ultimately determined by the amount of love, understanding and freedom experienced by its children... Every abandonment, every betrayal, every hateful act towards children returns tenfold a few decades later upon the historical stage, while every empathic act that helps a child become what he or she wants to become, every expression of love toward children heals society and moves it in unexpected, wondrous new directions." - Lloyd deMause -

" No one has yet fully realized the wealth of sympathy, kindness and generosity hidden in the soul of a child. The effort of every true education should be to unlock that treasure. The ultimate end of all revolutionary social change is to establish the sanctity of human life, the dignity of man, the right of every human being to liberty and well-being." - Emma Goldman (Russian-American lecturer and activist, 1869-1940)

IT'S ABOUT TIME A COURT SAID THIS

Federal Judge Blocks Citigroup’s Mortgage Settlement With S.E.C.

A federal judge in New York on Monday threw out a settlement between the Securities and Exchange Commission and Citigroup over a 2007 mortgage derivatives deal, saying that the S.E.C.’s policy of settling cases by allowing a company to neither admit nor deny the agency’s allegations did not satisfy the law. The judge, Judge Jed S. Rakoff of the Federal District Court in Manhattan, ruled that the S.E.C.’s $285 million settlement, announced last month, is “neither fair, nor adequate, nor in the public interest” because it does not provide the court with evidence on which to judge the settlement. The ruling could throw the S.E.C.’s enforcement efforts into chaos, because a majority of the fraud and other cases that the agency brings against Wall Street firms are settled out of court, most often with a condition that the defendant does not admit that it violated the law while also promising not to deny it.

FDA Declares Rick Perry a Vegetable

Texas Governor Approved for School Lunches

WASHINGTON (The Borowitz Report) – In a decision that raised some eyebrows in the nutrition community, the Food and Drug Administration announced today that it had declared Texas Governor Rick Perry a vegetable.

The decision, effective immediately, means that a serving of Mr. Perry would be approved for school lunches across the nation.

In an official statement, Mr. Perry said he was “surprised and honored” by the FDA’s decision.

“As a vegetable, I am honored to join the other three food groups,” said Gov. Perry. “Meat, dairy, and… nope, can’t do it. Oops.”

INTRODUCTION AND PREAMBLE
When in the course of human events it becomes necessary for the Citizens of a Nation to petition their own Government for a redress of grievances, the People have a duty to exercise their rights under the First Amendment collectively if they so choose. To this end, We the People hereby assert our right to peacefully assemble and petition our Government for redress when we feel that this is our best, and perhaps only remaining option to seek remedies.

We affirm that any lasting and workable solution must reach beyond mere politics, that political issues do not matter at a time when our collective voice has been nearly silenced. We believe that the current political climate has caused a paralysis of our Government. We find that our individual opinions mean little when we are no longer being properly represented. In fact, we believe that the Balance of Power between the Branches of our Government has been corrupted to the point where it can answer only to members of an affluent and politically active upper class. The impending result of this imbalance is that government of the People, by the People, for the People has almost perished from Our Nation. We believe that government has been influenced by an external source that has conspired to control it to the point of stalemate. We believe that this was forced upon us by "special interests", corporations, lobbyists, the banking and the financial sector including Wall Street and the Federal Reserve, who together have used unrestrained financial leverage leading to the corruption of many politicians, regardless of their political party, resulting in great damage to the People and to this Nation.

We hold these truths to be self-evident, that all are created equal regardless of their financial status. -- That we free Citizens of the United States are without exception endowed under a Federal Constitution granting us certain unalienable Rights. -- That among these Rights are Life, Liberty and the pursuit of Happiness. -- That to secure and protect these rights, our forefathers drafted this Constitution, ratified by the then several States and agreed to by the People. -- That this Constitution defines and protects us all with a system of Checks and Balances by which the powers and responsibilities of government would be divided amongst the Federal, the States and the People. -- That this original Social Contract in which those powers were granted has been repeatedly violated by the Federal government. -- That we no longer are represented by our Government. -- That we no longer have a voice in our Government. -- That the limits of power of the Federal Government have been deliberately and repeatedly breached. -- That our Government has become destructive towards the vast majority of the same People that they are supposed to protect. -- That outside influences have gained unreasonable power and influence within our Government. -- That the Fair Election system is being systematically dismantled and no longer allows for a full, on paper, verification and accounting of actual balloting. -- That We the People have the Fundamental Right and Patriotic Duty under the First Amendment of the Bill of Rights to peacefully assemble and to demand that the Government cease and desist from or correct any of these violations. -- That the Government cede back to the States and to the People all such Powers that they have unconstitutionally seized, regaining such Powers from the States via Constitutional Amendment if they are to have them at all. -- That our Government must Right these encroachments on the People by realigning itself to the Constitution. -- That vague interpretations of the Constitution should be clarified through civil discourse leading to a series of new Amendments and with full participation by the several States.

We also hold that the Constitution was originally designed to prevent the Federal government from encroaching upon the rights of the People and the States. Adjustments to Federal Powers were to be made only via Constitutional Amendment. We hold that this Amendment procedure has largely been ignored in recent history. In fact, when the Constitution was originally crafted, the political party as we know it today did not even exist. The modern era of rampant partisanship was not even envisioned by the Founders. We thus believe that the current "political party system" as it stands has served to divide this Nation to the point of paralysis. As a Great former President once said, "A house divided against itself cannot stand."

While we who have named ourselves the "99%" may each have our own individual personal concerns and grievances, we know that we must set them aside at this time due to a more pressing need to demand the return of the Representation that has been taken from us. Until such time, we contend that nothing can be accomplished in a spirit of true discourse.

Collectively we can all certainly agree upon these Truths that have led us to our outrage.

Paul Craig Roberts The Roads To War And Economic Collapse

One would think such a totally failed president would be easy to defeat. Given an historic opportunity, the Republican Party has put before the electorate the most amazingly stupid and vile collection of prospects, with the exception of Ron Paul who does not have the party’s support, that Americans have ever seen.

Unfortunately for Americans and the world, the US electorate lacks the intelligence and the awareness of their plight as denizens of a police state to elect Ron Paul, the last defender together with Rep. Dennis Kucinich of the US Constitution.

In Positive Economic Sign, Walmart Customers Killing Each Other to Buy Shit

Pepper Spraying, Homicide Bullish Indicators, Economists Say

MINNEAPOLIS (The Borowitz Report) – In what economists are hailing as a clear sign of economic recovery, Walmart customers across the USA jammed into stores on Black Friday, sometimes killing each other to buy useless shit.

“We have been looking for evidence that the economy is on the mend,” said Davis Logsdon, chairman of the economics department at the University of Minnesota. “When people resort to homicide to buy a Blu-ray player, that is very, very good news indeed.”

Mr. Logsdon said he was “impressed” by the lengths to which some Walmart customers were going to grab coveted sale items: “They’re using tactics we usually associate with the UC-Davis police.”

With many customers using pepper spray and other weapons to get a shopping advantage, however, Mr. Logsdon advised Americans not to enter a Walmart unarmed.

“If you want to get your hands on a doorbuster, you’d better have a firearm,” he said. “Fortunately, Walmart is offering several great doorbusters on firearms.”

Walmart and other retailers’ decision to commence their Black Friday sales a day early carries with it an added benefit for consumers, he noted: “Now, Americans will be able to declare bankruptcy one day earlier.”

All in all, Dr. Logsdon said that the increased violence and mayhem at retail outlets across the country was “a testament to the greatness of the American consumer.”

“Egyptians risk their lives for new government,” he said. “Americans bravely do the same for new flat screens.”

The supreme threat has never been from foreign Terrorists, but rather from what was done by our own public- and private-sector authorities (and the mentality they successfully implanted) in their name.

BIGGER SNOW STORM HITS NORTH IDAHO THURSDAY NIGHT 11-17-11

About a foot of powder fell overnight, but as soon as the temps rose to just above freezing, it turned to heavy slush which is hard to shovel or snowblow
The new slab is hardened so Rodger parked his truck with the snowplow blade on it to fix tomorrow because the windshield wipers and defroster wouldn't work and he couldn't see to plow. Very cold temps tonight and Sunday should make snow removal very hard for a few days, but temps should start to rise Tuesday
I had already broomed off both vehicles, but the snow kept coming down while we plowed and snowblowed (blew) to get the thermal mats off the new cement slab

She cites the advice of the late Catholic nun and activist Jackie Hudson to “take one more step out of your comfort zone” as an inspiration, saying, “It would be so easy to say, ‘Well I’m going to retire, I’m going to sit around, watch television or eat bonbons,’ but somebody’s got to keep ’em awake and let ’em know what is really going on in this world.”

CHRIS HEDGES: This Is What Revolution Looks Like

The historian Crane Brinton in his book “Anatomy of a Revolution” laid out the common route to revolution. The preconditions for successful revolution, Brinton argued, are discontent that affects nearly all social classes, widespread feelings of entrapment and despair, unfulfilled expectations, a unified solidarity in opposition to a tiny power elite, a refusal by scholars and thinkers to continue to defend the actions of the ruling class, an inability of government to respond to the basic needs of citizens, a steady loss of will within the power elite itself and defections from the inner circle, a crippling isolation that leaves the power elite without any allies or outside support and, finally, a financial crisis. Our corporate elite, as far as Brinton was concerned, has amply fulfilled these preconditions. But it is Brinton’s next observation that is most worth remembering. Revolutions always begin, he wrote, by making impossible demands that if the government met would mean the end of the old configurations of power. The second stage, the one we have entered now, is the unsuccessful attempt by the power elite to quell the unrest and discontent through physical acts of repression.

    James Howard Kunstler: Rudderless

    Rudderless
    By  James Howard Kunstler
Guest Writer for Greg Hunter’s USAWatchdog.com
The Penn State football sex scandal, and the depraved response of the university community at all levels, tells whatever you need to know about the spiritual condition of this floundering, rudderless, republic and its ignoble culture.
For nine years, head coach Joe Paterno covered up a grad student’s report of having witnessed former assistant coach Jerry Sandusky anally raping a ten-year-old boy in the athletic department’s shower room. The grad student, Mike McQueary, didn’t bother to call the police. He was later hired as Paterno’s defensive coordinator. Two other Penn State administrators were informed about the rape and let the incident slide, after which Sandusky went on to a lively career in serial child homosexual rape. For many years after the witnessed incident, he was permitted regular access to Penn State’s gyms, fields, and locker rooms, while cherry-picking victims from his own foundation, Second Mile, for needy children.
The intersection of America’s fake warrior culture of football with the nation’s fake moral and ethical culture is instructive. It has many levels, like a convoluted freeway intersection of on-ramps, off-ramps, and merge-ramps.
First is the pretense that college football is a character-building endeavor. Rather it’s an odious money-grubbing racket that chews up and spits out quasi-professional players who, with rare exceptions, only pretend to be students. It corrupts everyone connected with it. College football is little more than a giant conduit for vacuuming money out of alumni, hawking brand merchandise, and generating TV revenues. At Penn State, the racket sucked in about $70 million a year net profit. All over America, the old land-grant diploma mills pay their coaches million-dollar salaries, while academic adjunct professors can’t even get health insurance. At SUNY-Albany, the flagship campus of New York’s system, they got rid of the department of foreign languages, but the football team plays on. Meanwhile ordinary students rack up tens of thousands of dollars in unpayable college debt via a related racket in which free-flowing government-backed Sallie Mae loan money prompts colleges to boost tuition rates way beyond inflation rates.
Then there is the merge-ramp between religion and football. Was I the only person revolted by video of the phony “prayer” session held in the Penn State stadium just before Saturday’s “big game” with the University of Nebraska? Players from both teams led by Jesus-shouting cheerleaders affected to “pray” for Jerry Sandusky’s rape victims, an exercise that was joined and legitimized by the crowd with all the passion of a Nuremberg rally. When that easy little ritual was out of the way they could settle back and enjoy the game’s ersatz heroics with a clear conscience, and the tailgate barbeques that followed. A genuine sense of collective shame would have produced a different course of events – for instance cancelling the game, maybe the rest of the season, or perhaps even the entire football program in plain recognition of how foul and corrupt it is. That decision would have been up to the university’s board of directors and tells you all you need to know about corporate leadership in America today.
Perhaps even more disgusting than the pre-game prayer show was the rash of demonstrations the night the story broke. These weren’t about shame and repentance, just violent displays of sanctimonious “moral” support for an entire system in disgrace. Do you suppose these people could not have endured a night or two of uncomfortable silent reflection. And why didn’t the new president, or any other campus executive, make a pubic statement that all the prideful carrying-on was indecent? I wonder how many of the same students will be ground down to dust by the weight of their unpayable college loans.
Equally disgusting was the cable news media’s wall-to-wall coverage of the Penn State story, as if there weren’t other important events going on in the world – for instance the resignation of two European prime ministers due to a political crisis that could sink the global economic system. CNN turned the Penn State story into an instant reality-TV show, with play-by-play action and spin-o-rama scenario-flogging aimed mainly, it seemed, at how Coach Joe Paterno might manage to wiggle out of culpability in the civil lawsuits that are sure to dog him now until the end of his days.
What the public doesn’t know is how soon the sun will be setting on these giant universities in their entirety – football, classrooms, alumni golden circles, and all – as we enter the age of intense energy and capital scarcities. Remember: institutions, just like living organisms, often reach their greatest scale just before they go extinct. Resource constraints would be enough to get the job done, but it’s interesting to see how our programming failures and internal moral contradictions have reached the last limits of flamboyant grotesquerie in the same exact moment.
This is a nation with psychological boundary problems in every realm – the family, the school, the government, the corporation, the diocese, the police station, you name it. Meanwhile the so-called fine arts branch of our culture valorizes “transgressive” behavior – as if there were any behavioral boundaries left to cross. Maybe Jerry Sandusky should be sentenced to a one-man show at the Whitney Museum. Then just wait a week or so: we’ll get Jeffrey Dahmer, the Musical on Broadway.
Every new day that dawns lately gives further proof that we are a wicked people who deserve to be punished.

A Letter from Bank of America

    An Apology to Our Customers

NEW YORK (The Borowitz Report) – The following letter was sent today by Bank of America to all of its debit card customers:

    Dear Valued Customer:

As most of you probably know by now, last month we instituted a $5 monthly fee for all of our debit card users. To say that what followed this decision was a shitstorm would be a massive understatement.

Considering that just three years earlier taxpayers had bailed us out with billions of their hard-earned dollars, it’s understandable that Bank of America was compared to a person who, as he is pulled from a burning building, turns and kicks the fireman in the nuts.

That’s why we are writing to you today with a simple message: “Our bad.” And to tell you that we are refunding the $5 to you, effective immediately. All you have to do is pay a simple, one-time $10 refund fee.

You can receive your refund online, or pick it up at your nearest Bank of America branch, where a teller will hand the money directly to you for a simple, one-time $15 handling fee.

If you do visit your branch, feel free to use any of our services, including our state of the art ballpoint pens and deposit slips. (Prices on request.)

Again, accept our apologies for instituting the debit card fee. We have learned our lesson, and we make this solemn promise: next time we squeeze money from you, we'll do it in a way you won’t notice.

    Sincerely,

    Bank of America
